Preliminary Article: Definitions of the Contract Terms
In the remainder of these terms and conditions, the words below shall have the following meaning:
“Client”: means a natural person of full age having full legal capacity at the time of entering into the reservation contract, or a legal entity duly represented by a natural person having the standing and legal capacity to represent it.
“Hotel”: means the Tourisme Avenue hotel.
“Website”: an electronic service operated by the company Tourisme Avenue on the Internet network and accessible at the address indicated in the preamble hereto.
“Reservation Platform”: an electronic service connected to the Website and enabling an online reservation to be made for the Tourisme Avenue hotel.
I- Preamble
The company TOURISME AVENUE SAS (Société par Actions Simplifiée), registered under SIREN No. 562091025, entered in the Paris Trade and Companies Register (RCS) and located at 66 Avenue de la Motte-Picquet, 75015 Paris, operates the following reservation site:

This Website presents the Tourisme Avenue hotel and enables the reservation of rooms as well as hotel services relating thereto.
These GENERAL TERMS AND CONDITIONS OF SALE therefore apply to the Website mentioned above.
The Client acknowledges having had all the information necessary to make their choice and proceed with their reservation on this website:

– These general terms and conditions of sale apply to any reservation made on the Website of the Tourisme Avenue hotel by an individual client.
– These general terms and conditions of sale are not intended to apply to professional/business clients who have entered into a specific contract.
Any reservation made via the Website presupposes the consultation and complete and unreserved acceptance of these general terms and conditions of sale, as well as of the conditions of sale of the reserved rate expressly set out in the description of the rate selected at the time of reservation.
The Client’s acceptance of these general terms and conditions and of the conditions of sale of the rate becomes final upon ticking the box when making their reservation on the site; no reservation is possible without such agreement.
The Client acknowledges that they fully understand these general terms and conditions, written in French/English, and that they have the full legal capacity enabling them to enter into commitments under these general terms and conditions.
The following information appears on the Website:

– The essential characteristics of the accommodation offered by the Hotel;
– The additional and optional services offered;
– Photographs provided for indicative purposes only;
– Prices inclusive of all taxes, excluding tourist tax;
– The amount of the tourist tax as applied by the administrative authorities, which is liable to vary;
– The conditions of sale of the reserved rate;
– The payment terms;
– These general terms and conditions of sale;
– The period of validity of the offer and of its price.
The Client declares that this reservation is made for their strictly personal requirements. In view of their status as a consumer, they enjoy specific rights, which would be called into question in the event that the reserved services were not reserved for personal purposes.
All the information accessible on the Website, as well as these general terms and conditions of sale, is presented in both French and English.
II. Purpose :
These general terms and conditions of sale define the rights and obligations of the parties in connection with reservations made on the Website of the Tourisme Avenue hotel.
The Client acknowledges having read these general terms and conditions of sale and the conditions of sale of the reserved rate, which are accessible and available at all times on the Website. They accept them without reservation.
III. Duration :
These general terms and conditions of sale apply throughout the period during which the services of the Tourisme Avenue hotel are made available online.
The company TOURISME AVENUE reserves the right, without notice or compensation, to make changes to these general terms and conditions of sale and to close the website or the online reservation area, whether temporarily or permanently. To this end, we invite you to consult them regularly.
These general terms and conditions of sale are valid as at the date of the Client’s reservation.
If a later version appears after the Client’s reservation, these terms and conditions may not apply to their reservation.
The company TOURISME AVENUE shall not be liable for damage of any kind that may result from such changes and/or from any temporary unavailability, or indeed from the permanent closure of all or part of the site or of the services associated therewith, such as the online reservation area.
IV. Reservation :
The Client acknowledges having made their reservation in full knowledge of the facts and having obtained all the information necessary to that end. The reservation of a room is reserved for natural persons of full age and having legal capacity. By proceeding to reserve a room with the Tourisme Avenue hotel, the Client expressly declares that they fulfil these conditions.
The Client may reserve, on the Website, for personal purposes only, a maximum of 4 rooms for the same date. Any reservation of a greater number of rooms shall be subject to the conditions applicable by the company TOURISME AVENUE to Group reservations, thereby excluding the application of these general terms and conditions of sale.
Where applicable, the Client undertakes, as a matter of obligation, to contact the sales department of the Tourisme Avenue hotel by email or telephone in order to acquaint themselves with the specific conditions for group reservations and to complete such a reservation.
The Client is solely responsible for their choice of services and for their suitability to their needs, such that the liability of the company TOURISME AVENUE cannot be invoked in this respect.
The reservation is deemed accepted by the Client at the end of the reservation process.
Every reservation is personal to the named individual and may under no circumstances be transferred to a third party, whether free of charge or for consideration. Any reservation made on behalf of another person must be made in the name of the third party who is the holder of the stay.
V. Reservation process :
The Client may reserve a room on the reservation platform of the Website, which is accessible therefrom, by clicking on the “Book” button.
The Client specifies the dates of their stay and the number of persons wishing to stay. They may then choose the type of room as well as the additional services according to their needs, and select the rate offered for the selected date(s).
The Client may then confirm their choice by clicking on the “Book” button after having read the full description of the corresponding room(s) and of the services included.
The Client is then invited to complete a form in order to provide all of their personal information as well as that of the persons staying at the hotel. They must then provide their bank details in order to guarantee payment on arrival. The Client attests to the truthfulness and accuracy of the information provided.
The Client is then invited to confirm their reservation after having read and accepted the general terms and conditions of sale of the selected rate as well as the privacy policy of the reservation platform.
The reservation is confirmed. The Client accesses a page containing a summary of their reservation. A reservation confirmation is sent by email to the email address indicated by the Client in the form.
VI. Cancellation or modification conditions :
If the Client has booked a non-cancellable and non-refundable rate, they may under no circumstances cancel their reservation and may not claim any refund even if they so request.
If the Client has booked a flexible rate, then they may cancel or modify their reservation in accordance with the general terms and conditions of sale of the rate selected at the time of their reservation.
The cancellation or modification of a reservation may give rise to any charges indicated in the general terms and conditions of sale of the rate selected at the time of their reservation.
In order to cancel or modify their reservation, the Client must contact the Hotel, whose contact details are provided on the Website.
In the event of an exceptional occurrence, or of an impossibility to make the reserved room available to the Client, for instance in a case of force majeure, the Tourisme Avenue hotel may offer the Client a room of a higher category than that reserved, or an accommodation solution in a Hotel of at least equivalent category.
The Client is reminded, in accordance with Article L. 221-28 of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 221-18 of the French Consumer Code. The Client is also reminded that the conditions of sale of the rate reserved and accepted by them set out the terms for cancellation and/or modification of the reservation.
VII. Stay at the Tourisme Avenue hotel
The Client may be asked, on arrival at the Tourisme Avenue hotel, to complete a police registration form. To this end, the Client is required to present a valid identity document in order to verify whether or not the Hotel must complete the police registration form.
Important note: In the event of failure to present a valid identity document upon the Client’s arrival, the Hotel reserves the right to cancel the Client’s reservation purely and simply. The Hotel shall under no circumstances be required to pay the Client any compensatory indemnity.
The Client accepts and undertakes to make reasonable use of the room as well as of the Hotel’s common areas made available to them. Any conduct contrary to the principles of safety and/or hygiene, to public decency and/or to public order may lead the Hotelier to require the Client to leave the establishment immediately, without any compensation and/or without any refund if payment has already been made.
Any damage caused by the Client in the reserved room or in the common areas of the Hotel may be invoiced directly to them up to the amount of the damage recorded. Any item missing from the reserved room and duly recorded by the Hotel shall be invoiced directly up to its value.
All the Hotel’s rooms are non-smoking. Penalties equal at most to the price of the first night reserved may be applied if the Client fails to comply with the prohibition on smoking in their room.
The Tourisme Avenue Hotel has Internal Rules (Règlement Intérieur) intended for the Client. The Client accepts and undertakes to comply with the said rules. In the event of the Client’s failure to comply with any of the provisions of the Internal Rules, the Hotelier may invite the Client to leave the establishment. The Hotel shall under no circumstances be required to pay the Client any compensatory indemnity.
The Hotel makes common areas and facilities available free of charge, unsupervised, to which only the Hotel’s Clients — save as otherwise determined by the Hotel Management, which reserves the right to do so — have access.
The use of these facilities and their equipment is undertaken under the sole and entire responsibility of the Clients, who access them freely but only during opening hours.
Unaccompanied minors may not access them alone.
In the event of a malfunction of any equipment, or where access thereto is suspended or impossible for any reason whatsoever, the Client may not claim any loss or compensation against the Hotel. In the event of the Client’s failure to comply with any of these provisions, the Hotel may invite them to leave the establishment. The Hotel shall under no circumstances be required to pay the Client any compensatory indemnity.
The Client may occupy their room on the first day of their reservation from 3:00 p.m. They must vacate the room on the last day of their reservation before 12:00 noon. Failing this, an additional night will be invoiced to them. The Client may enter and leave the hotel 24 hours a day. They will then be invited to leave the room keys at reception.
The Client may request access to their room before 3:00 p.m. on the day of their arrival, or to keep their room after 12:00 noon on the day of their departure. This service must be subscribed to on site with the hotel teams, subject to payment of an additional sum and subject to availability.
The Tourisme Avenue hotel complies with the regulations relating to the reception of persons with reduced mobility.
The Tourisme Avenue hotel does not accept domestic animals.
Specific conditions of sale may apply to stays of more than 6 nights.
VIII. Warranties :
The Hotel is bound by the warranty of conformity of services, under the conditions set out in Articles L.212-1 et seq. of the French Consumer Code.
IX. Liability :
The photographs presented on the website are not contractual. Even though every best effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as accurate an impression as possible of the accommodation services offered, variations may occur, in particular on account of changes of furniture or possible renovations. The Client may not make any claim on this account.
In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements making up the offers of the Tourisme Avenue hotel appearing on the Website is strictly prohibited.
The company TOURISME AVENUE shall incur no liability for any indirect damage arising from these terms, in particular that arising from a third party, from the Client, or from the partners of the Tourisme Avenue hotel.
Hyperlinks may refer to sites other than that of the Tourisme Avenue hotel, which disclaims all liability as regards the content of those sites and the services offered. The company TOURISME AVENUE has put in place measures to protect and secure its information system against malicious acts. However, connection to the website and the making of a reservation entail, for the Client, the awareness and acceptance of the characteristics and limits of the Internet. This includes the absence of protection of certain data against possible misappropriation, hacking, or risks of contamination by viruses that may circulate on the network. The company TOURISME AVENUE disclaims all liability in the event of misuse or of any incident connected with the use of the computer or of any medium enabling access to the Internet, with the maintenance or malfunction of the website or of any other technical connection, and with the sending of information to an incorrect address.
Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Client shall result in the cancellation of the reservation at the Client’s expense, without prejudice to any civil or criminal action against the latter.
In connection with their reservation and their stay, the Client undertakes to behave reasonably and not to cause harm in any way to the members of the Hotel’s team as well as to the third parties present in the Hotel. Such conduct may lead the Hotel to expel the Client from the Hotel, without the Client being able to claim any right to compensation.
X. Price :
The prices relating to the reservation of services are indicated before and at the time of reservation.
The prices indicated are understood per room, for the number of person(s) and the date(s), at the time they are selected.
The prices are confirmed to the Client inclusive of all taxes and excluding tourist tax, in the commercial currency of the hotel, and are valid only for the period indicated on the site.
The total amount of the reservation is payable on site upon the Client’s arrival at the Hotel.
The client’s credit card will be requested at the time of reservation in order to guarantee payment of the reservation.
The tourist tax, indicated for each rate, is to be paid directly on site to the hotel. It is liable to vary.
The prices take account of the VAT applicable on the day of the order, and any change to the applicable VAT rate shall automatically be passed on to the prices indicated as at the invoicing date.
Any modification or introduction of new statutory or regulatory taxes imposed by the competent authorities shall automatically be passed on to the prices indicated as at the invoicing date.
Upon confirmation of the Client’s reservation, the total amount of the order will be indicated.
If the price indicated at the time of reservation is manifestly derisory, or if, by mistake, the price indicated was lower than the prices usually applied in the profession for an equivalent service, the Hotel reserves the right to cancel the reservation purely and simply, without any additional charge being attributable to it in this respect.
All reservations, whatever their origin, are payable in the local currency of the hotel, save for any specific provisions indicated on site.
Any extras and/or indemnities on account of damage or of missing items/furniture will be debited directly from the bank account corresponding to the payment card whose details were provided by the Client at the time of reservation. In this respect, the Hotel informs the Client that their bank details are retained as from the confirmation of their reservation. The Hotel reserves the right to use this data for the entire period necessary for the performance of the terms of these conditions of sale. The Client is informed in advance of the details and the amount of the debits that will be made from their account in the event of damage recorded at the end of their stay.
XI. Payment :
Save for any special conditions or rates selected, the Client provides their bank details as security for the reservation, by credit or private-label payment card (Visa, Mastercard, American Express), by directly entering, in the area provided for that purpose, the card number, together with its expiry date and the visual security code (it is recalled that the payment card used must be valid at the time of the stay). On the day of arrival at the Hotel, the Client must present themselves with the payment card that enabled them to guarantee the reservation or to make the prepayment. The Tourisme Avenue hotel may also ask them to present a valid identity document for the purposes of preventing payment card fraud.
Important note: In the event of failure to present a valid identity document upon the Client’s arrival, the hotel reserves the right to cancel their reservation purely and simply. The Hotel shall under no circumstances be required to pay the Client any compensatory indemnity.
Payment is made at the Hotel’s reception upon the Client’s arrival. The only means of payment authorised are those mentioned on the Website at the time of reservation.
At the time of payment, the amount that is debited at the time of reservation comprises: the price of the accommodation, the taxes relating to the accommodation, the price of catering, the taxes relating to catering, and any other additional services selected by the Client, excluding tourist tax and/or any other tax that may be due on account of the Client’s stay at the hotel.
XII. Personal data :
The Client is informed, on each of the forms for the collection of personal data, of the mandatory or optional nature of the responses by the presence of an asterisk.
In the absence of information identified as mandatory, the Hotel may be unable to register a reservation and to handle the latter’s complaints.
The personal data relating to the Hotel’s clients is collected, processed and retained by TOURISME AVENUE in accordance with the laws and regulations on personal data, and in particular with the French Data Protection Act (Loi Informatique et Libertés) of 6 January 1978, in its version currently in force, and with Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation – “GDPR”).
The Hotel’s Client benefits at all times from an individual right of access to their personal data, of rectification, of erasure of their data, of restriction of processing, of data portability, and to object to the processing of the personal data concerning them, as well as from the right to lay down directives relating to the fate of their personal data in the event of death. These rights may be exercised at any time and by any means with TOURISME AVENUE, and in particular:

XIII. Evidence agreement :
The entry of the required bank details, together with the acceptance of these general terms and conditions and of the reservation voucher or request, constitutes acceptance of the hotel contract between the parties, having the same value as a handwritten signature.
The computerised records kept in the computer systems of the company TOURISME AVENUE will be retained under reasonable conditions of security and regarded as proof of the communications, orders and payments made between the parties.
XIV. Force majeure :
The company TOURISME AVENUE may not be held liable towards the Client in the event of non-performance of its obligations resulting from an event of force majeure on French territory.
Likewise, the Client may not be held liable towards the company TOURISME AVENUE in the event of non-performance of their obligations resulting from an event of force majeure. Events of force majeure or fortuitous events shall be those usually recognised by the case law of the French Courts and Tribunals and by French positive law.
XV. Applicable law :
These general terms and conditions of sale are governed by French law.
This applies to the rules of substance as well as to the rules of form.
XVI. Entirety :
These general terms and conditions of sale, the conditions of sale of the rate reserved by the Client, and the acceptance of the confirmation of the reservation request express the entirety of the parties’ obligations.
No general or specific condition communicated by the Client may be incorporated into these general terms and conditions.
The documents forming the contractual commitments between the parties are, in decreasing order of priority: the reservation request (including the particular conditions of the reserved rate) that has been validated by the Client, and these general terms and conditions.
XVII. Amendment / modification of the general terms and conditions of sale :
These general terms and conditions of sale may be modified and/or supplemented at any time by the company TOURISME AVENUE. In such a case, the new version of the general terms and conditions of sale by internet will be put online. As from the time it is put online, the new version of the general terms and conditions of sale will apply to any new reservation on the Website.
XVIII. Consumer mediation :
In the event of a dispute between the professional and the consumer, they shall endeavour to find an amicable solution.
Failing an amicable agreement, the consumer has the option of referring the matter, free of charge, to the consumer mediator to whom the professional is affiliated, namely the Association des Médiateurs Européens (AME CONSO), within a period of one year from the written complaint addressed to the professional.
Referral to the consumer mediator must be made:
– either by completing the form provided for that purpose on the AME CONSO website: www.mediationconso-ame.com;
